The Pacific Legal Foundation is seeking a review by Michigan’s Supreme Court of an unconstitutional tax foreclosure scheme.

The Pacific Legal Foundation recently announced that a Michigan mother has appealed to the Michigan Supreme Court to uphold her constitutional right to fair compensation after her home was foreclosed on by Manistee County, sold, and the county kept $102,636 more than she owed. Chelsea Koetter, a single mother of two, fell behind on her property taxes in 2018 and mistakenly underpaid based on incorrect tax information. This resulted in an outstanding tax bill of $3,863 with interest, penalties, and fees. Koetter tried to recover the surplus proceeds through the circuit court, but her motion was rejected. The Michigan Court of Appeals also ruled against her, stating that the state law required her to follow a specific procedure to collect her rightful compensation. Represented by the Pacific Legal Foundation, Koetter is now seeking confirmation from the Michigan Supreme Court of her right to fair compensation without complicated claims procedures and tight deadlines hindering her. The case is titled “In re Petition of Manistee County Treasurer for Foreclosure.” Christina Martin, a senior attorney at Pacific Legal Foundation, criticized Michigan’s process as designed to fail and avoid compensating property owners fairly.
